WELCOME TO ISLAND CYCLE HIRE

These Business Terms and Conditions apply when you make or manage a booking with Island Cycle Hire for the hire of a bicycle, e-bike or related accessory, whether through our website, an online booking platform, in person or otherwise.

In these Business Terms and Conditions, Island Cycle Hire is referred to as we, us or our.

The person making or paying for the booking is referred to as you or the Customer, and each person who will ride or use Equipment is a Rider.

Equipment means any bicycle, e-bike and any helmet, lock, child seat, bicycle trailer or other accessory identified in your booking or Hire Form.

Start Time means the scheduled commencement time for the hire stated in your booking confirmation or Hire Form. Return Time means the scheduled return time stated in your booking confirmation or Hire Form.

These Business Terms and Conditions govern the commercial and booking relationship between you and us. The physical hire and use of Equipment is governed by the applicable Hire Terms and Hire Form, and any informed acknowledgement of risks or Liability Waiver that applicable law permits, each of which must be separately accepted by the person required to accept it; if there is an inconsistency, these Business Terms and Conditions prevail for booking, payment, cancellation and refund matters, and the Hire Terms prevail for collection, possession, return and physical use of Equipment, subject always to rights that cannot lawfully be excluded or limited.

WHAT ARE THESE BUSINESS TERMS AND CONDITIONS ABOUT?

These Business Terms and Conditions apply when you make, manage or cancel a booking with Island Cycle Hire for the hire of a bicycle, e-bike or related accessory, whether through our website at https://www.islandcyclehire.com.au, an online booking platform, in person or by another method we make available.

These Business Terms and Conditions govern the commercial and booking aspects of your relationship with us, including booking formation, availability, payment, security deposits or card pre-authorisations, changes, cancellations, refunds and no-shows.

Your physical collection, possession and use of Equipment is also subject to the applicable Hire Terms, Hire Form, Liability Waiver and any other document that you are required to separately accept as part of the booking or hire process.

Your access to and use of our website is governed by our separate Website Terms and Conditions, available at https://www.islandcyclehire.com.au/website-terms-conditions

Information about how we collect, hold, use and disclose personal information is set out in our Privacy Policy, available at https://www.islandcyclehire.com.au/privacy-policy

Our use of cookies and similar technologies is described in our Cookies Policy, available at https://www.islandcyclehire.com.au/cookies-policy

HOW DO I READ THESE BUSINESS TERMS AND CONDITIONS?

We have divided these Business Terms and Conditions into two parts to make them easier to read and understand.

The parts are:

Part A: terms that apply when you make, manage or cancel a booking with us, including booking formation, Equipment availability, payment, security deposits or card pre-authorisations, changes, cancellations, refunds and third-party service providers; and

Part B: liability, Australian Consumer Law protections and other general legal terms that apply to your booking and your relationship with us.

Your use of our website is governed separately by our Website Terms and Conditions.

Please contact us if you have any questions about these Business Terms and Conditions. You should not make a booking unless you have read and agree to the terms that apply to that booking.

DO I NEED TO READ THESE BUSINESS TERMS AND CONDITIONS AGAIN?

The version of these Business Terms and Conditions that applies to a confirmed booking is the version you accepted when that booking was made, unless you and we agree otherwise or a change is required by law.

We may update these Business Terms and Conditions from time to time by publishing an updated version on our website.

Any updated version will apply to bookings made after the updated terms take effect and will not retrospectively change the terms of an existing confirmed booking unless you agree to the change or applicable law permits or requires it.

You should review the Business Terms and Conditions each time you make a new booking. The date shown at the beginning of these Business Terms and Conditions indicates when they were last updated.

PART A FOR WHEN YOU MAKE A BOOKING

1 BOOKINGS

(a) You may make a booking for the hire of a bicycle, e-bike or related accessory through our website, an online booking platform we use, in person or by another method we make available.

(b) When you submit a booking request, you confirm that:

(i) you are at least 18 years old and have legal capacity to enter into a binding agreement with us;

(ii) if you make a booking for one or more Riders, you are authorised to provide their booking information and make or pay for the booking, but you do not accept the Hire Terms or Liability Waiver on behalf of an adult Rider; if a Rider is under 18 years old, you are that Rider's parent or legal guardian and are authorised to make the booking and give any consent that may lawfully be given for them;

(iii) the information you provide in connection with the booking is accurate and complete; and

(iv) if you provide a debit card, credit card or other payment method, you are authorised to use that payment method.

(c) Submitting a booking request is an offer by you to book the Equipment and services identified in the booking request on these Business Terms and Conditions.

(d) A booking is not confirmed merely because you submit a booking request, payment details are entered or an automated acknowledgement is generated.

(e) A binding booking is formed when we accept your booking and send you a booking confirmation, or otherwise expressly confirm the booking with you.

(f) Our acceptance of a booking is subject to availability of the requested Equipment and successful payment or any other payment arrangement agreed with us.

(g) If we cannot accept your booking, including because the requested Equipment is unavailable or there is an error in the booking information or price displayed, we will notify you and, if you have already paid an amount for a booking that we do not accept, refund that amount.

(h) The physical collection, hire and use of Equipment is also subject to the Hire Terms, Liability Waiver and any other document that we require you to separately review and accept as part of the booking or hire process.

2 CUSTOMER AND RIDER ELIGIBILITY

(a) You must be at least 18 years old and have legal capacity to make a booking with us.

(b) The person identified in the booking as the person who will ride or use the Equipment is the Rider.

(c) The Customer may book and pay for one or more Riders, but each adult Rider must separately satisfy the applicable eligibility requirements and accept the Hire Terms, Hire Form and any Liability Waiver required for that Rider before Equipment is released to them.

(d) Where the Rider is under 18 years of age, the Customer must be the Rider's parent or legal guardian and must have authority to make the booking and provide any consent required in connection with the hire.

(e) A Rider may use an e-bike only if the Rider and e-bike satisfy the age, power, speed, use and other requirements applying to that type of vehicle under Queensland law; a compliant bicycle or power-assisted bicycle generally does not require the Rider to hold a driver licence or vehicle registration, but any minimum age or lawful exemption applying to the particular e-bike or place of use must be met.

(f) Each Rider must satisfy any age, identification, licence, permit, authorisation or other eligibility requirement that applies to the Equipment under applicable law or that is reasonably disclosed as a condition of the hire.

(g) Before releasing Equipment, we may require and reasonably verify evidence relevant to the Customer's or each Rider's identity, age or eligibility, but we will request only evidence reasonably necessary for the applicable legal or disclosed hire requirement and handle it in accordance with our Privacy Policy.

(h) You must ensure that information provided to us about the Customer or Rider is accurate and complete.

(i) We may refuse to release Equipment if:

(i) the Customer or Rider does not satisfy an applicable eligibility requirement;

(ii) reasonably requested identification or evidence of eligibility is not provided;

(iii) information provided in connection with eligibility is materially inaccurate or incomplete; or

(iv) releasing the Equipment would, in our reasonable opinion, be unsafe or unlawful.

(j) If, on reasonable grounds, we refuse to release Equipment because a disclosed eligibility requirement has not been satisfied or reasonably requested evidence has not been provided, we may treat the affected hire as a cancellation within 24 hours only to the extent the failure is attributable to the Customer or Rider; any amount retained is subject to the cap, reasonable-loss assessment and replacement-booking refund mechanism in the Cancellation by You provisions, and we will provide a full refund if the refusal resulted from our error, an undisclosed requirement or a matter for which we are responsible.

(k) Nothing in these Business Terms and Conditions requires a Rider to hold a licence, permit or other authorisation unless it is required by applicable law.

3 ELECTRONIC ACCEPTANCE

(a) These Business Terms and Conditions may be provided to and accepted by you electronically.

(b) Where our booking process asks you to accept these Business Terms and Conditions, you may indicate your acceptance using the electronic acceptance method made available to you, including by selecting an acceptance box or button, providing an electronic signature or otherwise completing an electronic acceptance step.

(c) An electronic acceptance made through the booking process has the same effect between you and us as acceptance in writing, subject to applicable law.

(d) We may retain electronic records of your acceptance, including the version of these Business Terms and Conditions accepted and information recording when the acceptance occurred.

(e) Acceptance of these Business Terms and Conditions does not by itself constitute acceptance of any Hire Terms, Liability Waiver or other document that our booking or hire process requires you to separately accept.

(f) Where separate acceptance of another document is required, that document will only apply according to its own acceptance requirements.

4 EQUIPMENT AND AVAILABILITY

(a) We will use reasonable efforts to make available the Equipment identified in your confirmed booking.

(b) Descriptions, photographs and images of Equipment displayed on our website or booking platform are provided to help you select the type of Equipment you wish to hire. The particular Equipment supplied may differ in colour, appearance or other non-material respects from photographs displayed online.

(c) Unless your booking expressly identifies a particular bicycle, e-bike or accessory by model or other unique identifier, your booking is for the relevant type or category of Equipment rather than a particular item.

(d) All Equipment is subject to availability.

(e) If Equipment included in your confirmed booking becomes unavailable before the hire begins because of breakdown, damage, safety concerns or another circumstance outside our reasonable control, we will notify you as soon as reasonably practicable and may offer you suitable alternative Equipment.

(f) You are not required to accept alternative Equipment. If we cannot provide the booked Equipment or a suitable alternative that you agree to accept, we will refund any amount you paid for the affected Equipment or hire.

(g) Nothing in this clause limits any right or remedy you may have under the Australian Consumer Law or any other applicable law.

5 PAYMENT

(a) The fees and charges applying to your booking will be disclosed to you during the booking process, in your booking confirmation, Hire Form or otherwise before you are required to pay them (Fees).

(b) Unless otherwise stated, all Fees:

(i) are in Australian dollars;

(ii) include GST where GST is applicable; and

(iii) apply to the hire period, Equipment and other services identified in your booking.

(c) You must pay the Fees in the amount, manner and at the time disclosed to you as part of the booking process or otherwise agreed with us.

(d) We may require payment of the applicable hire Fees before the hire begins.

(e) We do not charge a surcharge for payment by Visa, Mastercard, eftpos or American Express.

(f) We may use Stripe or another third-party payment provider to process payments, refunds, security deposits or card pre-authorisations.

(g) Your use of a third-party payment provider may also be subject to that provider's terms and privacy policy.

(h) Except to the extent that applicable law makes us responsible, we do not control the operation or availability of a third-party payment provider's systems.

(i) If we identify an error in a price or Fee before your booking is confirmed, we will notify you and give you the opportunity to proceed at the correct price or cancel the booking.

(j) We will not increase the agreed price of a confirmed booking solely because of a pricing error without your agreement. If a confirmed booking cannot reasonably be honoured because of an obvious and genuine pricing error, we may cancel the affected booking and will refund any amount you have paid for it, subject to your rights under applicable law.

5.2 SECURITY DEPOSIT OR CARD PRE-AUTHORISATION

(a) We may require a security deposit or card pre-authorisation as a condition of releasing Equipment to you.

(b) The amount of any security deposit or card pre-authorisation will be disclosed to you during the booking process, in the Hire Form or otherwise before the Equipment is released.

(c) Where a card pre-authorisation is used, the relevant amount may be temporarily held or reserved against the available balance or credit limit of your payment card without being immediately charged to your account.

(d) You authorise us and our payment provider to convert all or part of a card pre-authorisation into a charge, or deduct from a security deposit, only after the relevant liability has arisen, for an amount properly payable by you under the applicable Hire Terms or these Business Terms and Conditions and supported by reasonable evidence, including where applicable:

(i) additional hire or overnight charges;

(ii) reasonable repair or replacement costs for loss or damage for which you are responsible;

(iii) reasonable recovery costs for Equipment that is not returned;

(iv) reasonable additional cleaning costs; or

(v) another amount expressly payable by you under the applicable hire agreement.

(e) Before applying or charging an amount for loss, damage, theft, non-return or another additional cost, we will rely on reasonably available evidence and assess the amount in accordance with the applicable Hire Terms.

(f) We will not retain or charge an amount from a security deposit or card pre-authorisation for loss, damage or costs for which you are not responsible under the applicable agreement or law.

(g) Any unused security deposit will be refunded or any unused card pre-authorisation will be released after the Equipment has been returned and we have had a reasonable opportunity to assess its condition.

(h) The time taken for a released card pre-authorisation or refund to become available to you may depend on your bank, card issuer or payment provider and is outside our control.

6 CHANGES TO YOUR BOOKING

6.1 CHANGES REQUESTED BY YOU

(a) If you ask to change a confirmed booking, including the hire date, hire time, hire period or type of Equipment, we will use reasonable efforts to accommodate the change but cannot guarantee that the requested change will be available.

(b) Any change is subject to Equipment availability and may result in a change to the Fees.

(c) A requested change does not take effect until we confirm it with you.

(d) If we cannot accommodate a requested change and you choose to cancel the booking, the cancellation provisions below apply.

6.2 CANCELLATION BY US

(a) We may cancel a booking before the hire begins if:

(i) the booked Equipment becomes unavailable because of breakdown, damage or a safety issue;

(ii) we reasonably consider that the hire cannot proceed safely or lawfully;

(iii) severe weather, an official warning or another circumstance outside our reasonable control materially affects our ability to provide the booked hire;

(iv) you do not satisfy an eligibility requirement applying to the hire or the Equipment;

(v) you have not paid an amount required to confirm or commence the booking; or

(vi) another circumstance arises that makes it reasonably impracticable for us to provide the booked hire.

(b) We will notify you as soon as reasonably practicable if we cancel a booking.

(c) If we cancel a booking for a reason that is not caused by your breach, ineligibility or failure to comply with these Business Terms and Conditions, we will offer you the choice of:

(i) rescheduling the affected booking to another reasonably available date or time; or

(ii) a refund of the amount you paid for the affected booking.

(d) If we cancel because you do not satisfy an applicable eligibility requirement, have provided materially inaccurate information or have otherwise materially breached these Business Terms and Conditions, any amount retained or refunded will be determined reasonably having regard to the circumstances, the cancellation provisions below and applicable law.

6.3 CANCELLATION BY YOU

(a) You may cancel a booking by contacting us using the contact details or cancellation method made available as part of the booking process.

(b) If you cancel more than 24 hours before the scheduled Start Time, we will refund the amount you paid for the cancelled booking.

(c) If you cancel 24 hours or less before the scheduled Start Time, we may retain 50% of the amount paid for the cancelled booking and refund the remaining 50%.

(d) If Equipment from a booking cancelled 24 hours or less before the scheduled Start Time is subsequently re-hired by another customer for substantially the same hire period, we will refund the cancellation amount retained to the extent that the replacement booking has reduced or avoided the loss arising from your cancellation. If the replacement booking means that we have not suffered any remaining reasonable loss or cost as a result of your cancellation, we will refund the full cancellation amount retained.

(e) We are not required to advertise, discount or otherwise take special steps to obtain a replacement booking.

(f) Any cancellation amount retained by us will not exceed an amount that is reasonable having regard to the loss or costs arising from the cancellation and applicable law.

6.4 NO-SHOWS

(a) Ordinarily, a genuine no-show is non-refundable. However, Island Cycle Hire may, at its discretion, consider genuine extenuating circumstances and provide a full or partial refund, credit or other reasonable remedy.

(b) If you arrive late, we will use reasonable efforts to provide the booked Equipment for the remaining hire period, but the agreed Return Time will not automatically be extended.

(c) Any extension is subject to availability and any additional Fees disclosed to and agreed by you.

6.5 WEATHER

(a) You are responsible for considering ordinary weather conditions when deciding whether to proceed with a booking.

(b) If you choose not to proceed because of weather but we reasonably consider that the hire can still be provided safely and lawfully, the cancellation provisions above apply.

(c) If we cancel the booking because severe weather, an official warning or other conditions mean that we reasonably consider the hire cannot proceed safely, the Cancellation by Us provisions apply.

(d) Nothing in this clause limits any right or remedy you may have under the Australian Consumer Law or any other applicable law.

6.6 REFUNDS

(a) Where you are entitled to a refund under these Business Terms and Conditions, we will process the refund using the original payment method where reasonably practicable.

(b) The time taken for a refund to appear in your account may depend on your bank, card issuer or payment provider and is outside our control.

(c) Nothing in these Business Terms and Conditions excludes, restricts or modifies any refund, replacement, resupply or other remedy to which you are entitled under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

7 THIRD-PARTY PLATFORMS AND SERVICE PROVIDERS

(a) We may use third-party platforms and service providers in connection with our booking and hire services, including providers of online booking systems, payment processing, electronic signing, website services and communications.

(b) These providers may include Booqable, Stripe or other providers we use from time to time.

(c) Where you access or use a third-party platform or service directly, your use of that platform or service may also be subject to the third party's own terms and privacy policy.

(d) The use of a third-party platform does not change the identity of the party providing the bicycle, e-bike or accessory hire. Unless expressly stated otherwise, your booking and hire are with Island Cycle Hire.

(e) We are responsible for performing our obligations under these Business Terms and Conditions and any other agreement between you and us, notwithstanding that we may use a third-party provider to assist us.

(f) To the maximum extent permitted by law, we are not responsible for loss or delay caused solely by the independent acts, omissions, systems or services of a third-party provider that are outside our reasonable control, except to the extent that we are legally responsible for that provider or the loss or delay.

(g) If a third-party booking or payment system is unavailable or experiences a technical issue, please contact us if you require assistance with a booking, payment, cancellation or refund.

(h) Nothing in this clause excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

PART B LIABILITY AND OTHER LEGAL TERMS

8 LIABILITY

8.1 AUSTRALIAN CONSUMER LAW

(a) Nothing in these Business Terms and Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or other protection under the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth), or any other law that cannot lawfully be excluded, restricted or modified.

(b) Where the Australian Consumer Law applies to our services, you may have rights and remedies if those services do not comply with an applicable consumer guarantee.

8.2 WARRANTIES

(a) Except for any guarantee, warranty, condition or other right that cannot lawfully be excluded, we do not give any warranty or representation about our booking or hire services other than those expressly stated in these Business Terms and Conditions or another agreement between you and us.

(b) Nothing in this clause affects any obligation we have to provide services with due care and skill, to provide services that are reasonably fit for a purpose you make known to us where the law requires that result, or otherwise to comply with applicable law.

8.3 LIABILITY

(a) To the maximum extent permitted by law, we are not responsible for loss, damage, cost or expense to the extent that it is caused or contributed to by:

(i) your breach of these Business Terms and Conditions;

(iii) your failure to satisfy an eligibility requirement applying to a booking or hire;

(iv) your failure to follow reasonable instructions relating to a booking, collection or return; or

(v) an act or omission of a third party or a circumstance outside our reasonable control, except to the extent that we are legally responsible for that act, omission or circumstance.

(b) Nothing in this clause limits our liability to the extent that loss or damage is caused by our negligence, breach of these Business Terms and Conditions, failure to comply with an applicable consumer guarantee or another matter for which liability cannot lawfully be excluded or limited.

(c) Liability arising from the physical possession, use, loss, theft or damage of Equipment is also governed by the applicable Hire Terms and, where relevant, the Liability Waiver separately accepted as part of the hire process.

8.4 CONSEQUENTIAL LOSS

(a) To the maximum extent permitted by law, neither you nor we are liable to the other for indirect or consequential loss that was not reasonably foreseeable as a result of the relevant breach or event.

(b) This exclusion does not apply to:

(ii) loss of or damage to tangible property;

(b) A party raising a dispute should provide the other party with sufficient information to understand the issue and the outcome being sought.

(c) You and we must reasonably cooperate in attempting to resolve the dispute.

(d) Nothing in this clause prevents either party from:

(i) seeking urgent or interlocutory relief;

(ii) making a complaint to or seeking assistance from a regulator, consumer protection body or other authority;

(iii) bringing a claim in a court or tribunal; or

(iv) exercising any right or remedy under the Australian Consumer Law or another applicable law.

(b) Subject to any right you may have to bring a claim in another court or tribunal under applicable law, you and we submit to the jurisdiction of the courts and tribunals of Queensland and any courts hearing appeals from them.

10.2 WAIVER

(a) A failure or delay by either party to exercise a right under these Business Terms and Conditions does not operate as a waiver of that right.

(b) A waiver is effective only if given in writing by the party granting it and applies only to the particular circumstances for which it is given.

10.3 SEVERANCE

(a) If any provision of these Business Terms and Conditions is void, invalid or unenforceable, it will be read down to the extent necessary to make it valid and enforceable if possible.

(b) If it cannot be read down, the provision will be severed to the extent of the invalidity or unenforceability without affecting the remaining provisions.

10.4 ASSIGNMENT

(a) You must not assign or transfer your rights or obligations under these Business Terms and Conditions without our prior written consent.

(b) We may assign or transfer our rights or obligations under these Business Terms and Conditions as part of a genuine sale, transfer or restructure of our business, provided that doing so does not materially reduce your rights.

10.5 ENTIRE AGREEMENT

(a) These Business Terms and Conditions record the agreement between you and us concerning the commercial and booking aspects of your booking.

(b) They operate together with any Hire Terms, Liability Waiver, Hire Form and other document that you separately accept as part of the booking or hire process.
